These Terms of Service (the “Terms”) govern your access to and use of the “ProductPilot – Bulk AI Product Optimization” application (the “App”).
This App is operated by an independent developer. If you do not agree to these Terms, do not install or use the App.
By installing or using the App, you (“the merchant”, “you”) agree to be bound by these Terms.
1. Overview of the App
ProductPilot provides AI-powered tools that help Shopify merchants generate, enhance, and manage product images and associated metadata.
Features may include:
AI-generated product photos (studio, lifestyle, 3D templates)
generative fill and background replacement
metadata and tag optimization
credit-based image processing
publishing assets back to the Shopify store
The App is designed exclusively for merchants using the Shopify platform.
2. Eligibility
To use the App, you must:
be a Shopify merchant or an authorized staff/admin user,
have the authority to act on behalf of the store,
comply with all applicable Shopify policies and laws.
3. Access, Authentication & Sessions
Use of the App requires OAuth authorization through Shopify.
You agree that:
Shopify’s login system controls access,
we may store your shop domain, session details, and granted scopes,
uninstalling the App immediately revokes access and triggers data cleanup.
Session data is handled according to the App’s Data & User Privacy Policy.
4. Subscriptions, Credits & Billing
The App uses a subscription and credit system.
a) Billing
All billing is managed via Shopify’s App Billing.
By subscribing, you authorize Shopify to charge the corresponding fees.
b) Credits
Each generation requires a specific number of credits.
Required credits are clearly displayed before each operation.
Credits may expire according to your plan details.
Credits are non-refundable except where required by Shopify’s policies or applicable law.
c) Changing or Canceling Your Plan
You may:
upgrade or downgrade your plan,
cancel your subscription,
at any time through the App or Shopify Admin.
Access remains active until the end of the current billing period.
5. Acceptable Use
You may not use the App to:
generate illegal, harmful, abusive, defamatory, or infringing content,
interfere with or disrupt the App’s infrastructure,
bypass credit usage, rate limits, or security protections,
reverse-engineer or copy the App’s code, design, or algorithms.
We reserve the right to suspend or terminate access for violations.
6. Intellectual Property
All rights to the App, including software, algorithms, UI, templates, models, and documentation, belong to the independent developer or their licensors.
You retain ownership of:
your original product images and metadata,
the AI-generated outputs created for your store (subject to subprocessors’ terms).
You grant the App a limited license to process your store assets solely for providing the App’s features.
7. Data & User Privacy
Your privacy is governed by the App’s Data & User Privacy Policy, which is incorporated into these Terms.
Key points:
No Protected Customer Data (PCD) from your shoppers is collected or processed.
Only merchant-level data, product metadata, generated assets, subscription info, and session data are handled.
External services include Shopify Admin API, Wasabi S3, OpenAI, and Redis.
You may have rights under GDPR or other laws.

8. Data Retention & Deletion
Data retention follows these principles:
Session data is deleted upon uninstall via webhook.
Generated images and metadata may be retained for up to 12 months unless you request deletion sooner.
Billing/subscription data may be retained as required for legal or financial compliance.

9. Service Availability & Changes
The App may evolve over time.
We may modify, update, or discontinue parts of the App, including features, credit logic, integrations, or pricing.
We will notify merchants of material changes through email or in-app notifications.
We do not guarantee uninterrupted availability or error-free operation.
10. Disclaimer of Warranties
The App is provided “as is”, “as available”, without warranties of any kind.
We do not guarantee that:
AI-generated outputs will be accurate or appropriate for all purposes,
the App will function without interruption or errors,
use of the App will improve merchant performance or sales.
You use the App at your own risk.
11. Limitation of Liability
To the fullest extent permitted by law:
The developer is not liable for any indirect, incidental, consequential, punitive, or special damages.
Total liability is limited to the amount paid by you for the App in the preceding 3 months.
If your jurisdiction does not allow certain limitations, they apply to the maximum extent legally allowed.
12. Termination
You may uninstall the App at any time. This immediately terminates the App’s access to your store.
We may suspend or terminate your access if:
you violate these Terms,
the App is misused,
fraudulent activity or abuse is detected.
Sections related to intellectual property, payment, privacy, and liability survive termination.
13. Governing Law
These Terms are governed by the laws of Poland,
excluding conflict-of-law principles.
